An industry group provides two great things - knowledge and networking. As with any business, both of these are very important to an organization's success. Your Industry Credit Group is a place where credit professionals in the same industry network on a regular basis for the primary purpose of exchanging credit information such as payment experience on current and prospective customers and sharing industry-specific best practices to increase knowledge, resources and skills.

Why do I need an industry credit group?

Whenever two or more competitors get together, the potential antitrust risk is high. Any discussion of customers, prices, distribution or territories can very easily cross over into prohibited topics, putting the entire company at risk. The United States government does not hesitate to investigate any charge of price fixing or discriminatory pricing practices, as we can see regularly on television and in the newspapers. You need an industry credit group because the activities and meetings of industry credit groups are supervised by trained NACM Southwest personnel who monitor diligently to assure compliance with US Antitrust laws, as well as anti-defamation and confidentiality protections. We keep the required records – and only the required records - and prepare reports and information for the meetings in a manner that assures that each and every member can confidently report that any information obtained or discussed at an NACM Southwest industry credit group meeting fell well within the guidelines proscribed by law, and NACM Southwest is in a position to affirm that no such discussion occurred.

The information exchanged at group meetings is "up-to-the-minute"...today's news. Important facts, in addition to the basic trade line, are available from other group members, and it is commonplace for members to uncover past paying records of "new" businesses by naming the principals involved. In addition, the trust developed between group members makes available an extended resource of credit experience information.

What do they do at an industry credit group meeting?

Regularly scheduled meetings are held among member companies who share a common customer base for the primary purpose of exchanging historical, factua paying experience information. Members are encouraged to bring their new applications, delinquent accounts, NSF checks and current A/R agings to the meetings and to participate honestly and in good faith in the exchange of credit experience information and other discussions.

These meetings are legal and ethical, for informative and constructive purposes only and federal antitrust regulations are strictly enforced. There must never be any agreement among the members to sell or not to sell, or in any way to restrict free trade. Members are admonished not to intentionally attempt to influence other members' decisions by offering opinions or advice, but to share only factual, historical information.

What makes it safe to discuss customers?

It is absolutely legal for merchants to share historical, factual data about customers for the prevention of fraud. The trick is getting the information without stepping over the line. Therefore, a trained NACM Southwest representative attends every meeting and acts as antitrust monitor and recording secretary. NACM Southwest is responsible for scheduling and publicizing meetings, arranging accommodations, handling all bookkeeping, and maintaining the group's by-laws, member roster, meeting records, etc. NACM Southwest personnel stay current with antitrust and other applicable law, and are responsible (during the meeting and anytime members with common customers are gathered together under the NACM umbrella) for assuring that all members remain in the "safe zone" at the meeting.

Who can participate?

Many groups have Standing Rules or Bylaws, governing eligibility for group membership. However, any company who qualifies is allowed into a group (or it could be an antitrust violation, right, to put a company into a non-competitive position by denying membership?). Members who do not pay their dues and fee timely or members who violate antitrust, anti-defamation or confidentiality may also be denied continuing membership.

Any full-time credit department employees of member companies may attend meetings. All information exchanged at the meetings must be held in strict confidence within the member company's credit department and is to be used for credit purposes only.
